服務條款及細則 | Terms and Conditions of Service

本條款及細則（「本條款」）規管閣下使用由 TriTerra Technology Limited（「本公司」、「我們」或「我們的」）透過我們的3T充電手機應用程式及位於指定酒店場地的3T充電站提供的電動車充電服務（「服務」）。透過開設帳戶、使用手機應用程式或使用我們的任何充電設施，即表示閣下同意受本條款約束。請仔細閱讀。
These Terms and Conditions (“Terms”) govern your use of the EV charging services (the “Services”) provided by TriTerra Technology Limited (“Company”, “we”, “us”, or “our”) through our 3T Charging mobile application and at our 3T Charging stations located at the designated hotel premises. By creating an account, using the mobile app, or utilising any of our charging facilities, you agree to be bound by these Terms. Please read them carefully.
1. 定義 | Definitions
– 「帳戶」 指透過我們的手機應用程式開設以使用服務的用戶帳戶。
“Account” means the user account created through our mobile app to access the Services.
– 「充電站」 指我們在指定地點提供的壁掛式直流充電終端設備（每部共兩支充電槍）。
“Charging Station” means the wall-mounted DC charging terminal units with two (2) charging guns each provided by us at the designated location.
– 「應用程式」 指我們用於控制充電過程及管理付款的專有手機應用程式。
“App” means our proprietary mobile application used to control the charging process and manage payments.
– 「用戶」、「閣下」 或 「你的」 指使用服務的任何個人或實體。
“User”, “you”, or “your”**means any individual or entity using the Services.
2. 帳戶註冊 | Account Registration
2.1 要使用服務，閣下必須透過我們的應用程式註冊一個帳戶。閣下聲明並保證在註冊時提供的所有資料均為準確、完整及最新的。
To use the Services, you must register an Account via our App. You represent and warrant that all information provided during registration is accurate, complete, and current.
2.2 閣下須全權負責維護閣下帳戶登入憑證的保密性，並對閣下帳戶下發生的所有活動負責。如發現任何未經授權使用閣下帳戶的情況，閣下必須立即通知我們。
You are solely responsible for maintaining the confidentiality of your Account login credentials and for all activities that occur under your Account. You must notify us immediately of any unauthorized use of your Account.
2.3 閣下必須年滿18歲方可註冊帳戶及使用服務。
You must be at least 18 years old to register an Account and use the Services.
3. 預付系統及電子支付 | Pre-Payment System and E-Payment
3.1 本服務以預付方式運作。用戶在使用充電服務前，必須透過應用程式以接受的電子支付方式（包括信用卡、Apple Pay及支付寶）為其帳戶充值。
The Services operate on a pre-payment basis. Users are required to top up their Account credit using accepted e-payment methods (including credit card, Apple Pay, and Alipay) via the App before initiating a charging session.
3.2 所有充值均為最終決定。除法律規定外，充值金額不可退還及不可轉讓。未使用的餘額將保留在閣下的帳戶中以供日後使用，並受本條款約束。
All top-ups are final. Except as required by law, top-up credits are non-refundable and non-transferable. Unused credit will remain in your Account for future use, subject to these Terms.
3.3 本公司保留隨時修改接受的支付方式或充值金額的權利，恕不另行通知。
The Company reserves the right to modify the accepted payment methods or top-up amounts at any time without prior notice.
4. 充電服務及費用 | Charging Service and Fees
4.1 服務費用：充電費用將根據充電期間消耗的電量（以千瓦時計算）從閣下的預付帳戶餘額中扣除。適用的每千瓦時費率將在開始充電前於應用程式上顯示。
Service Fees: The charging fees will be deducted from your pre-paid Account balance based on the electricity consumed (in kWh) during the charging session. The applicable rate per kWh is as displayed on the App prior to commencing the session.
4.2 轉接頭：請注意，本充電站配備歐標（CCS2） 充電接口。需要使用國標轉（GB/T） 接頭的用戶，必須向酒店接待處借用相關轉接頭。本公司對因使用該等轉接頭而引致的任何損壞或不兼容問題概不負責。用戶須全權負責確保轉接頭的兼容性及安全使用。
Adapters: Please note that the Charging Station is equipped with European Standard (CCS2) connectors. For vehicles requiring GB/T (Chinese Standard) adapters, Users must borrow such adapters from the hotel reception desk. The Company is not responsible for any damage or incompatibility arising from the use of such adapters. Users are solely responsible for ensuring adapter compatibility and safe usage.
4.3 佔用費：為確保所有用戶公平使用，如閣下的車輛在充電完成後仍連接充電站，可能會收取佔用費。具體的佔用費政策及寬限期將於應用程式上說明。
Occupancy Fees: To ensure fair access for all users, idle fees may apply if your vehicle remains connected to the Charging Station after the charging session has completed. The specific idle fee policy and grace period will be communicated on the App.
5. 用戶行為及安全 | User Conduct and Safety
5.1 閣下同意遵守所有適用法律、本條款及在現場張貼的安全須知，使用服務及充電站。
You agree to use the Services and Charging Station in accordance with all applicable laws, these Terms, and the safety instructions posted at the site.
5.2 每次使用前，閣下必須檢查充電槍、電纜及任何轉接頭是否有明顯損壞。如發現任何缺陷或損壞，請勿使用設備。
Before each use, you must inspect the charging gun, cable, and any adaptor for visible damage. Do not use the equipment if you identify any defect or damage.
5.3 在任何情況下，切勿試圖拆卸、維修或改裝充電站。
Do not attempt to disassemble, repair, or modify the Charging Station under any circumstances.
5.4 閣下不得將服務用於任何非法、欺詐或濫用目的，亦不得以可能損壞、使失效、超負荷或損害充電站的方式使用服務。
You shall not use the Services for any unlawful, fraudulent, or abusive purpose, nor in a manner that could damage, disable, overburden, or impair the Charging Station.
6. 免責聲明及責任限制 | Disclaimer and Limitation of Liability
6.1 免責聲明：服務及充電站是按「現狀」及「現有」基礎提供。在法律允許的最大範圍內，我們不就服務作出任何明示或暗示的保證，包括但不限於對適銷性、特定用途適用性及不侵權的暗示保證。我們不保證服務將不間斷、安全或無誤。
Disclaimer: The services and charging station are provided “As is” and “As available.” to the fullest extent permitted by law, we make no warranties, express or implied, regarding the services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, secure, or free from errors.
6.2 責任限制： 在任何情況下，本公司、其關聯公司、董事、僱員或代理人均不對任何間接、附帶、特殊、後果性或懲罰性損害賠償承擔責任，包括但不限於利潤、數據、使用權、商譽或其他無形損失，該等損失源於 (I) 閣下使用或無法使用服務；(II) 任何第三方的行為或內容；(III) 未經授權訪問或更改閣下的傳輸或數據；(IV) 因使用充電站而對閣下車輛或財產造成的任何損害，包括但不限於因不兼容的轉接頭或車輛造成的損害；或 (V) 與服務有關的任何其他事宜，無論是基於保證、合同、侵權（包括疏忽）或任何其他法律理論，即使我們已被告知該等損害的可能性。
Limitation of Liability: In no event shall the company, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (I) your use or inability to use the services; (ii) any conduct or content of any third party on the services; (iii) unauthorised access to or alteration of your transmissions or data; (iv) any damage to your vehicle or property arising from the use of the charging station, including but not limited to damage caused by incompatible adapters or vehicles; or (v) any other matter relating to the services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been informed of the possibility of such damage.
6.3 彌償：閣下同意就以下事項產生的任何及所有索賠、損害、義務、損失、責任、成本或債務及開支（包括但不限於律師費）為本公司、其關聯公司及其各自的高級職員、董事、僱員及代理人進行抗辯、彌償及使其免受損害：(a) 閣下使用及存取服務；(b) 閣下違反本條款的任何規定；(c) 閣下侵犯任何第三方權利，包括但不限於任何版權、財產或隱私權；或 (d) 任何聲稱閣下的行為對第三方造成損害的索賠。
Indemnification: You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your conduct caused damage to a third party.
7. 終止 | Termination
7.1 我們可能基於任何原因（包括但不限於閣下違反本條款）立即暫停或終止閣下的帳戶及服務使用權，恕不另行通知且不承擔任何責任。
We may suspend or terminate your Account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
7.2 終止後，閣下使用服務的權利將立即終止。除法律另有規定外，閣下帳戶中的任何剩餘餘額將被沒收。
Upon termination, your right to use the Services will cease immediately. Any remaining credit in your Account will be forfeited unless otherwise required by law.
8. 條款變更 | Changes to Terms
我們保留全權酌情權，隨時修改或替換本條款。如屬重大修訂，我們將在任何新條款生效前提供合理的通知。在變更生效日期後繼續使用服務即表示閣下接受新條款。
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the new Terms.
9. 管轄法律及爭議解決 | Governing Law and Dispute Resolution
本條款應受香港特別行政區法律管轄並按其解釋。因本條款引起或與本條款有關的任何爭議應提交香港法院專屬管轄。
These Terms shall be governed and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.
